Este Acuerdo es celebrado por DIGITAL MATE JOINT STOCK COMPANY (DIGIMATE) y la organización o individuo que acepta estos términos ("Cliente", "Usted" o "Su").

1. Derechos y responsabilidades de los proveedores de servicios (DIGIMATE)

DIGIMATE no recopila información personal de los clientes, salvo la necesaria para crear una cuenta. Esta información se utiliza únicamente para la comunicación con el cliente, la confirmación de pedidos o la asistencia técnica, y no se comparte con terceros, salvo cuando lo exija la ley o para permitir el uso del servicio.

DIGIMATE no almacena ni proporciona enlaces a archivos de imagen creados en Mojo AI. Los clientes son responsables de descargar sus propios archivos.

DIGIMATE no se responsabiliza del contenido proporcionado o creado por los clientes y podría exigir pruebas de los derechos de propiedad intelectual en caso de controversias. La empresa se reserva el derecho a tomar medidas como advertencias, moderación de contenido, suspensión o revocación de cuentas en caso de incumplimiento.

DIGIMATE no asume ninguna responsabilidad por pérdidas o daños, incluidos aquellos causados ​​por virus o descargas inseguras.

2. Rights and responsibilities of service users

You may use the Free Tier or purchase a Premium Plan. DIGIMATE may limit access, suspend accounts, or block re-registrations in cases of fraud or abuse.

You are responsible for ensuring your content:

• Complies with Vietnamese law and international treaties.
• Does not infringe others’ rights.
• Avoids political, offensive, religiously insensitive, violent, or defamatory content.

By accessing the Service, you confirm you are 13+ or have parental consent. Parents are responsible for their children’s use.

DIGIMATE is not responsible for AI-generated content accuracy or suitability.

3. Copyright and intellectual property rights

You can provide input when using the service, such as text, images, etc., referred to as "Input," and receive results generated and returned by the service based on the input, referred to as "Output." Input and Output are collectively referred to as "Content." 

You have the right to own your content, and you have full authority to use it for personal or commercial purposes and are responsible for its lawful use. Additionally, Mojo AI has the permanent right to use your images for purposes such as copying, publishing, reproducing, processing, editing, advertising, publicly displaying, licensing, distributing, or creating similar content in any applications or services. Mojo AI retains these contents and uses them for commercial purposes to provide, maintain, advertise, and improve the service. 

DIGIMATE is the legal owner of this website and of the development technology, the Mojo AI solution trademark. Statement of Intellectual Property Rights of DIGIMATE to the objects featured on this website and all content of the website, including but not limited to the text, design, graphics , interface, images, code, trademarks, trade names, company or product logo templates... are all copyrights of DIGIMATE or a licensed third party protected under regulations of the Law on Intellectual Property of Vietnam and related documents. 

Nothing on this website or in these Terms of Use contains or implies the transfer of ownership of the above-mentioned technology, trademarks or content. on this website for customers. 

Any act of copying, quoting, modifying, distributing, publishing, circulating or re-using, directly or indirectly, the content on this website for commercial purposes or any other purpose under any any form without the prior written consent of DIGIMATE; or any act that directly or indirectly infringes or damages the Mojo AI solution's development technology and trademark is deemed to infringe upon the lawful property rights of DIGIMATE

DIGIMATE has the right to request customers to terminate the use of the service at the website https://ai.mojo.vn/, take full responsibility before the law and have to compensate for any loss or damage. caused to DIGIMATE (if any) if there is any action in violation of this provision.
 

4. DMCA and takedown policy

Notice procedures We respect the intellectual property rights of others.

A statement, under penalty of perjury, that you genuinely believe that the material identified above was removed or disabled as a result of mistake or misidentification and will be removed or disabled.

5. Refund policy

After the customer has read, agreed to the Terms of Use, confirmed the purchase of the service pack and completed the payment procedure on the website, we are not responsible for refunding the value of the service package that the customer has paid. in any case. In case there is an error related to the service provided by Mojo AI, please contact Mojo AI's Customer Care call center for answers.

6. Change Terms of Service

DIGIMATE reserves the right to change, update or supplement any provision of these Terms of Use from time to time without prior notice. Such changes, updates or additions will be effective immediately upon posting to the website https://digimate.vn/. 

If the customer continues to access or use the services on the website after the changes, updates or additions are posted, the customer has accepted and agreed to such changes, updates or additions.

7. General Terms 

All terms of use constitute the entire agreement between Mojo AI and the customer. 

These Terms of Use and all activities arising from the website https://digimate.vn/ will be analyzed, evaluated and governed by the laws of Vietnam. 

In the event that one provision of use is invalidated by a decision of a court of competent jurisdiction, the validity of the remaining provisions shall not be affected. 

In the event of any breach of the Terms of Use, DIGIMATE. reserves the right to seek all remedies and take necessary actions in accordance with the Laws to prevent such violations. and damages arising from the customer's failure to comply with the Terms of Use. Mojo AI always welcomes comments from customers about website content. If there is a part of this website that you believe is infringed upon by a third party, please report it to Mojo AI Management.

8. Availability and quality of service 

We continuously strive to improve the Service to make it better. 

The Service may be modified and changed, including but not limited to the artistic style of the Assets, the algorithm used to generate Assets, and the features available to Customers. There is no guarantee provided regarding the quality, stability, uptime, or reliability of the Service. 

Please do not create any dependencies on any attributes of the Service or Assets. We will not be legally responsible to You or Your subsequent customers for any harm resulting from Your reliance on the Service.

Both the Service and Assets are provided to the Customer on an "AS IS" basis, WITHOUT ANY WARRANTIES OR CONDITIONS, whether express or implied, including but not limited to any warranties or conditions of OWNERSHIP RIGHTS, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. You are solely responsible for determining the suitability of using or distributing the Assets and assume all risks associated with using the Service.

DIGIMATE reserves the right to suspend or prohibit Your access to the Service at any time and for any reason. You are not permitted to use the Service for competitive research. You are not allowed to reverse engineer the Service or Assets. You are not permitted to use automated tools to access, interact, or generate Assets through the Service. Only one user may use the Service per registered account. Each user of the Service may only have one account.  

We reserve the right to investigate complaints or reports of violations of our Service Terms and take any actions that we deem appropriate, including but not limited to reporting any suspected unlawful activities to law enforcement authorities, regulatory agencies, or other third parties, and disclosing any necessary or appropriate information to individuals or organizations involved in user profiles, email addresses, usage history, posted materials, IP addresses, and traffic information.

9. Payment

We may invoice you for your use of the Service through a third-party payment service provider. The terms of service of the third-party service provider will govern and replace this Agreement in the event of any conflict.

You are free to cancel your subscription at any time. We also reserve the right to terminate your access to the Service for any reason, including violation of the Community Guidelines or other inappropriate use of the Service. You will not be refunded for the current subscription period, but you will not be charged after the current subscription period ends.

10. Community Guidelines 

Please be kind and respectful to each other and to the staff. Avoid creating or using text prompts that are disrespectful, harassing, or abusive. Violence or harassment in any form will not be tolerated

No adult or gory content. Please refrain from creating content that is shocking or visually disturbing. We automatically block certain types of text inputs. Respect others' creativity. Do not publicly repost others' creations without their permission. Be mindful of sharing. You can share your creations outside the Mojo AI community, but consider how others may view your content.
